1. Acceptance of Terms

By accessing or using Revenue Brain, you agree to be bound by these Terms. If you do not agree, do not use the platform.

2. Services

Revenue Brain helps businesses capture missed calls, create lead records, send SMS follow-up communications, manage conversations, and view analytics related to lead recovery.

3. Eligibility and Account Responsibility

• You must be authorized to act on behalf of your business account.
• You are responsible for maintaining account credentials and access controls.
• You are responsible for all activity under your account.

4. Messaging and Compliance Responsibilities

You are solely responsible for complying with all applicable laws and regulations related to telephony and messaging, including consent, disclosures, and opt-out handling requirements (including TCPA and carrier rules). You agree not to use the platform for spam, harassment, fraud, or unlawful communications.

End-user opt-out keywords such as STOP and support keywords such as HELP must be honored in accordance with applicable requirements.

Opt-Out: Reply STOP to unsubscribe at any time.

6. Fees and Billing

Paid plans, billing cycles, and usage-based fees (including third-party messaging usage) are defined in your subscription or order terms. Fees are non-refundable except as required by law or expressly stated in writing.

7. Data and Privacy

Your use of Revenue Brain is also governed by our Privacy Policy. You represent that you have the legal right to provide and process business/customer communication data through the platform.

8. Acceptable Use

You agree not to:

• Use the platform to violate laws or third-party rights
• Send unlawful, deceptive, or abusive communications
• Attempt unauthorized access to systems, accounts, or data
• Interfere with platform operation or security

9. Third-Party Services

Revenue Brain may rely on third-party services (such as Twilio and hosting providers). We are not responsible for third-party outages, changes, or actions outside our control.

10. Intellectual Property

Revenue Brain and related software, branding, and materials are owned by us or our licensors. Subject to these Terms, you are granted a limited, non-exclusive right to use the platform for your internal business purposes.

11. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REVENUE BRAIN SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR REVENUE ARISING FROM USE OF THE PLATFORM.

13. Indemnification

You agree to defend, indemnify, and hold harmless Revenue Brain and its operators from claims, liabilities, damages, and expenses arising from your use of the platform, communications sent through your account, or violation of these Terms.

14. Suspension and Termination

We may suspend or terminate access for violations of these Terms, unlawful conduct, security risks, or non-payment.

15. Modifications

We may update these Terms from time to time. Updated Terms become effective when posted, unless otherwise stated.
